APPLICANT REQUESTS THAT:
He be awarded the Air Force Good Conduct Medal (AFGCM).

APPLICANT CONTENDS THAT:
The AFGCM is awarded for a one-year period of service in the
combat zone.
The Board should consider it in the interest of justice to
consider his case as he is trying to assemble his medals for a
collage.
The applicants complete submission, with attachment, is at
Exhibit A.

STATEMENT OF FACTS:
According to the applicants AF Form 7, Airman Military Record,
he was assigned to Vietnam from 9 Jun 68 to 24 May 69.
On 11 Jun 69, he was honorably released from active duty.
He served 1 year, 4 months and 16 days on active duty.
According to the applicants DD Form 214, Armed Forces of the
United States Report of Transfer or Discharge, Block 24,
Decorations, Medals, Badges, Commendations, Citations and
Campaign Ribbons Awarded or Authorized, the AFGCM is lined thru.

The AFGCM is awarded to Air Force enlisted personnel during a
three-year period of active military service or for a one-year
period of service during a time of war. Airmen awarded this
medal must have had character and efficiency ratings of
excellent or higher throughout the qualifying period including
time spent in attendance at service schools, and there must have
been no convictions of court martial during this period. Air
Force personnel who were previously awarded the Army Good
Conduct Medal and after 1 Jun 63 qualified for the AFGCM could
wear both medals.

AIR FORCE EVALUATION:
ARPC/DPTS recommends denial. AFI 36-2803, Air Force Awards and
Decorations Program, is specific in stating that the decrease to
one year for award of the AFGCM is when the United States is at
war, as declared by the U.S. Congress. The applicants service
in Vietnam does not fit in the category of a declared war. The
last declared war by Congress was in World War II in 1941. The
applicants record shows an intentional deletion/correction for
award of the AFGCM during 1968, which falls within his Vietnam
period of service.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 25 Apr 14, a copy of the Air Force evaluation was provided to
the applicant for review and comment within 30 days (Exhibit D).
As of this date, this office has not received a response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by
existing law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file
3. Insufficient relevant evidence has been presented to
demonstrate the existence of error or injustice. We took notice
of the applicant's complete submission in judging the merits of
the case; however, we agree with the opinion and recommendation
of the Air Force office of primary responsibility and adopt its
rationale as the basis for our conclusion that the applicant has
not been the victim of an error or injustice. Therefore, in the
absence of evidence to the contrary, we find no basis to
recommend granting the relief sought in this application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that
that the application will only be reconsidered upon the
submission of newly discovered relevant evidence not considered
with this application.
